have XP Home on Laptop
want to put XP pro on laptop
Can I install over XP Home with a new license

Yes (if your copy of XP Professional is a retail version, not an OEM one),
but buying a second license for your existing copy is usually more expensive
than just buying a complete second Upgrade CD from a discount source.

Your question isn't exactly clear. If you have a copy of XP Pro that's
a retail version and not installed on another system then yes you can
use it to upgrade the laptop's XP Home. If you have an unused XP Pro
license Key then any XP Pro CD of the same type can be used for the
upgrade. An OEM version of Pro that's not been installed previously can
be used, but OEM versions are tied to the first computer on which they
are installed so if it's been used once it can't be moved.

Make sure you have all the drivers needed for the laptop from the laptop
manufacturer's web site.
