I am trying to upgrade from 98se to xp home but it gives me the error "The
language of this installation of Windows differs from the one you are
installing. The option to upgrade will not be available." Does anyone know
if there is a way to fix this??

The language of the upgrade must match the language of the incumbent OS..
that is to say, you can't use an English upgrade over a French OS.. you will
have to clean install..
