broken cd & xp upgrade question

Hi,

I want to buy the XP upgrade but my 98 upgrade CD was broken a while
ago and I threw it away. (On a side note is it legitimate for me to
use this as a qualifying media?) I still have the EULA and CD key for
the 98 upgrade and I am wondering if I could use a friend's 98 retail
edition CD when the installation asks for a qualifying cd, but use my
CD key instead of his.

Any help is appreciated.

Hello
it will not ask for a key code you will just have to put the CD in and that
is it and there is nothing illegal about it for you are still licensed for
98

Your Windows 98 Cd is required during the upgrade policy and future
re-installs. If you remove Windows 98, the XP Upgrade CD needs to find some
important files on the Winodws 98 CD to complete the install.

The upgrade for Home Edition is for 98. I've experienced
this in the past, called MS and they walked me through
how I can trick the upgrade since most people are honest
and MS knows that you would call if you didn't have 98.

Since you have the 98 CD key, you can use any 95/98/Me for Home upgrade or
95/98/Me or 2000 if the Pro upgrade CD as qualifying media on a clean
install .
Borrow your friends and if MS is still supplying replacement CD's for 98 get
one for future reinstalls. If MS is no longer supplying replacement 98 CD's
make a copy off your friends.

In practice, yes you could. You won't even need to enter the key. But
keep the documentary evidence of your 98 around in case the men in black
come by :)). A Retail CD is evidence - does not matter if it was an
upgrade or full one
