XP SP1 "Snooping"

I may be mistaken so please bear with me.

I thought that I have read where part of the agreement when you upgrade to
SP1 allows Microsoft the "authority" to do some sort of scan on your system.
Is this true? Is there any way to upgrade to SP1 and not let Microsoft have
access to my system.

No!

SP1 WILL scan to see if you have a valid copy of Windows XP. You do, don't
you! If you don't, it will not install.
