My computer crashed approx 3 months ago. Every time I
tried to restart the computer it came up with a message
about 'whistler'. I had an IT tech look at it and he said
it was a beta version for developers and software
companies to try out and assess for Microsoft and that it
shouldn't have been sold to me. I bought my computer at
almart about 4 years ago, about the same time the beta
version was introduced. It cost me a few hundred to get
fixed. Now who should foot the bill?

Even if you could blame someone else for using a computer for 3+ years with
a trial OS and not noticing, I think the fact you used it for 4 years
without knowing it would negate any claim.

Not only what I said in my other response, but you got taken for a few
hundred dollars to reinstall? Did you not get a CD or way to restore your
computer to the state at which it was when you purchased it?
