Problem with Highpoint HPT370 on Abit KT7-RAID motherboard

I occasionally have problems with my KT7 RAID mobo on
Windows XP. The drive light will flash occasionally but
the system will hang for ages until it sorts itself out.
If I go into the event view I see the following errors,
alternating for about 11 times.

hpt3xx Error
The device, \Device\Scsi\hpt3xx1, did not respond within
the timeout period.

Disk Warning
An error was detected on device \Device\Harddisk0\D during
a paging operation.

I have tried scandisk but there are no errors. I am using
the latest drivers and bios.

Very occasionally also, Windows will fail to boot up. It
hangs on a dimmed Windows XP logo.

I have also run scan disk during boot up. It will run okay
for upto 48% then hang for 20 minutes before continuing
upto 75%, then hang again, and then continue okay. No
errors found!

I have a KT7-RAID motherboard, with the latest
downloadable BIOS, version A9 dated 11 July 2002. I am
using the Abit 4in1 driver version 4.38. There's a 900MHz
Athlon CPU and 256Mb of PC133 memory.

I have a seagate barracuda IV 80Gb, 7200 rpm on the RAID
channel, and LG DVD rom as master on primary IDE and a
Sony CDRW as master on secondary IDE.

I also have an S3 64Mb graphics card (clone), and a
creative soundblaster PCI16.

I have been informed by someone on the Abit side that
Windows XP does not support the Highpoint version 1, but
will support version 2.

My questions are:

Is this true? Does Windows XP only support the later
version?

If this is true I am screwed because I can not update the
BIOS for the onboard Highpoint controller since it is on
the motherboard itself, and Highpoint advise that for
controllers on the motherboard you refer to the
motherboard manufacturer and not them. Abit do not supply
a BIOS upgrade for this motherboard and RAID controller
and I refuse to install a 'botched' unsupported upgrade
that is probably unstable.

Also, I do not consider that it is reasonable to shell out
more money on a PCI RAID controller or move the hard disk
on to the slower IDE channels.

Is there an workaround or fix using proper supported
drivers?

If not, how do I go about getting a refund for Windows XP,
since it doesn't support my motherboard?
