MS Paint 'Save As' DELETES existing file.

The Save As function no longer creates a copy of the file - it DELETES IT !!!

Create a picture in Paint. Save it as a Test.bmp, then Save As as Test.gif
(using the same main name).

Paint has now deleted your Test.bmp, leaving only the Test.gif.

If this intentional then I wish to reconsider my position vis-a-vis the
death penalty!

Note also the very substantial change to the way Paste works in the Vista
Paint (i.e only allowed under certain conditins).

My question is: Can one copy the XP version of Paint to Vista?

I have checked it in my Vista Ultimate. Its working fine here.
First I created a BMP file and then saved it as jpg and gif, but it didn’t
delete the BMP file.
I have all 3 files in same folder. ;-)

Obviously that will happen. If you save as a bmp first and then in the ***same dialogue box*** that is open you then save it as a gif then the file will be overwritten with the last extension given because you are using the same file name that you gave the photo or image. If you want to save it as both with different extensions then you need to save it as bmp first ( example ***Trevor.bmp***) and then for gif you will have to rename or change the file name( example ***Trevor 1.gif***). Notice the 1 in the file name when saving as gif

If you are saving both in the same exact name the last save will overwrite the previous one. Hence your issue.
