Ive severly confused. when i run chesk disk i get a message that it cannot
run because the volume is in use by another process. it ask if i want the
volume to be checked on start up-- this however does not help the problem im
trying to fix

any suggestion? they would be greatly apprieated

Mario,

Not sure why it works this way, but chkdsk will only run
on reboot. I think that it is because all of the system
files need to be inactive for the utility to acurately
read the current status of the files.

Simple really:

CHKDSK cannot check the hard drive whilst Windows and other applications are
running: thus it needs to load and run and finish before Windows loads.

That's why one permits it to shut down and restart the PC.

If you think you have a problem, use your System Install CD and use recovery
mode and run CHKDSK from there, type HELP and you can get all the options
listed.

I hope this will help you fix your unstated problem.
