Can I sell My XP Home Retail

I bought a second hand laptop from a guy who decided to buy a mac. He had
bought Windows XP HOME for it. he no longer needed it so just said here have
it. He basically just gave me the genuine Win Xp Home cd (looks kind of
holographic), and the cdkey which he cut out of the box.

So I have two things, the cd, and a cdkey that was cut off the original box.

He tossed the box he said.

I dont want XP Home, so I want to just sell it, can I legally do that? It
was activated once I think because he said he had it installed on the Laptop.

Hah I dont know, I had a guy on a newgroup offer me $50 bucks Canadian.. But
I want to make sure its legal before I do it..

indirect transfer, such as a consignment. Prior to the transfer, the end
user receiving the Software must agree to all the EULA terms."

If it is a retail copy (CD 'for PCs without windows' or for 'PCs with
Windows 98 or ME') then that is freely transferable.and you can sell it
on. And if it is installed on the laptop it should be fine *there* even
if an OEM one ('for supply only with a new PC') , but it can't be
transferred. Check at
Start - All Programs - Accessories - System Tools - Activate Windows

If that says it is already activated then all is fine for continued use
on the laptop

The really important thing is the 26 character CD 'Product Key'. The
label on the box says 'Do not lose this' and means it

My understanding is that M$ has all the registration info 'roll
off' it's info data storage, after 120 days. So do with it what you
want. M$ doesn't even know you have it.

Please correct me if I'm wrong.

But that is for the benefit of those changing their hardware a lot: it
does *not* make it legal to install on two machines or to sell it while
retaining it on one
