Can I legally sell this Windows XP Home Retail?

I bought a second hand laptop from a guy who decided to buy a mac. He had
bought Windows XP HOME for it. he no longer needed it so just said here have
it. He basically just gave me the genuine Win Xp Home cd (looks kind of
holographic), and the cdkey which he cut out of the box.

So I have two things, the cd, and a cdkey that was cut off the original box.

He tossed the box he said.

I dont want XP Home, so I want to just sell it, can I legally do that? It
was activated once I think because he said he had it installed on the Laptop.

You might have to give them a call. It did it with a MB/system
transplant from one sys to another and registered the old for someone
else

I think they allow it once or twice.

It sounds like it is retail and not OEM.
If it is retail, you can sell it and/or transfer all you want as long as it
is not installed on more than one computer at a time.

OEM is normally permanently tied to the original computer regardless the
condition of the original computer and can never be transferred.

Read the EULA for details.
