Bought XP unaware that is was supposed to be for new PC

I bought Windows XP home edition on ebay and unawares to
me it was the oem version that was supposed to come with
a new computer. Because I was not aware of this when I
bought it is my version legal?

I am certain it is a legal copy, but is it legal for me
to install it since it was supposed to come with a new
computer?

Yes, you can install it but it must be a "clean install".

I hope you paid for it with a credit card, which in the UK brings some
measure of protection against defective products! Your problem might come
when you try to activate it. You may want to consider whether it would be
best to activate as soon as possible or wait until the very last minute.

Perhaps. If that particular license has _never_ been installed on
any other PC, and if it is a generic OEM CD (not a proprietary CD
branded for a specific make/model computer), then you may have a
legitimate license. Ask the seller for the specific history and
antecedents of the CD and license.
