I just purchased a new IBM ThinkPad which comes with only the IBM XP Recovery
Software on the harddrive. IBM will not provide me an XP CD.

If I contact Microsoft, will they provide me with a copy of the OS if I can
prove I have a valid license? And if so, how do I contact them for this
request?

Thanks,

Dave

They will probably issue you a full XP CD no questions asked. Their
support number is on their website.

No. Microsoft will not issue you a Microsoft OEM CD.
Your IBM provided Product Key will only work with the
IBM Recovery Software.

OK you have an OEM version of XP on an IBM Thinkpad.

IBM and MS have entered into an agreement for the inclusion of and the
distribution of an OEM edition of Windows in their products. Now under the
terms of the agreement, IBM is to package the XP software in whatever manner
the see fit in order to accomplish:
1. Distribution of the media
2. Inclusion of the software
3. Protection of Microsoft's intellectual property
4. Adherence to the terms of the OEM agreement

For this they buy XP at a ridiculously cheap price. Microsoft is under no
obligation to support IBM customers for the replacement or supply of XP
software it's IBM's responsibility.

They just DO NOT have an IBM version in the back cupboard.

If they were to provide you a copy, it would be one that enables you greater
priveledges than afforded to you by IBM's OEM version. By the way, every OEM
supplier is in the same position, although others may choose to provide their
customers with a package closer to the 'white box' Microsoft OEM CD.

You may be asked to hand over some money.

Get to know exactly how to backup and recover the Thinkpad with IBM's
software or buy a disk backup / recovery application such as Norton Ghost -
you'll be so glad of this one day in the future I guarantee it.

Microsoft does not supply CDs or other support for OEM versions of
Windows. The computer manufacturer/assembler (IBM in your case) has
signed a contract with Microsoft which provides that they (IBM) and
not Microsoft are responsible for all warranty and end-user support
for the OEM versions of Windows that they sell with their computers.

In other words, IBM has agreed to assume the role and responsibilities
of the Original Equipment Manufacturer (OEM) with regard to this
software. To make this situation perfectly clear to the computer
purchasers I believe that the product should be identified as "IBM
Windows XP, licensed from Microsoft" rather than Microsoft Windows XP,
but that is just my personal view.

The OEM agreement between IBM and Microsoft only requires that IBM
provide the computer purchaser with "a method" by which the operating
system can be resotored to the "as it left the factory" state. And by
providing the System Recovery partition on the hard drive IBM has
complied with this requirements.

See http://onlinehelp.bc.ca/oem_software for more detailed information
about OEM software.

You can make a backup copy of the Recovery Partition if you want,
using either a CDRW/DVDRW drive (if you Thinkpad has one) or by
purchasing an external USB2 hard drive and copything the Recovery
Partition to it.

But if IBM will not provide you with the actual CD then your only
other option would be to purchase a new copy of Windows XP.

Good luck

All they're required to provide you is a means of restoring the
computer to its original, ex-factory state. The Recovery CD meets this
requirement. If it doesn't meet your personal requirements, you should
have purchased a different laptop from a different manufacturer, one who
would provide you with the product you wanted.

No, Microsoft doesn't provide OEM installation CDs; only the computer
manufacturer can do that, if they so choose.

sorry you're totally out of luck . WTF is MS going to do something about
this ?

What could Microsoft possibly do about this? It was the OP's choice to
buy the laptop he did, from the manufacturer he chose. It's not
Microsoft's responsibility to make amends for the OP's changing his mind
about what he wanted.

Dave,

Other than myself, all the other posters have said that Microsoft will
not issue you a Windows XP CD gratis, nor will they issue you an OEM
Windows XP CD. Please note that in my original post I never said they
would issue an OEM CD - just that they might issue you an XP CD if you
prove you have a valid license.

Here is their phone number from their web site: 1-425-635-3311

Let us know if they issue you an XP CD.
