Windows XP (& 98) re install

Question #1:
My computer hard drive crashed and I had to put in a new one. Can I
re-install the original Windows 98 or XP home that I had one there before
with the same key code or will that violate my EULA license?

Question #2:
I also have a computer that I am upgrading to sell. It originally had XP
Home, can I transfer the Windows program, key code and license to the new
hard drive as long as I will not be using the old one anymore. Will it be
legal for the new buyer as long as they have all of the paperwork and cd's?
 
1. You should be fine installing the OS on the new hard drive. If by some
chance it doesn't like your KEY you will be able to call MS and they will get
you squard away.
2. You should be fine there too.

Question #1 - yes you can change components in a computer and continue to
use your current Windows install. That will not violate the EULA. The only
time a person might have trouble is if they have an OEM version of XP that
is BIOS locked and they swap in a new motherboard. Which you aren't doing so
don't worry about it.

Question #2 - If the computer came with XP preinstalled by the manufacture
and it is an OEM version then it is forever tied to the system. You can not
legally install it on another system. If you sell the computer you must
either sell it with all the Windows XP disks it came with or destroy those
discs. However if the XP install was from a retail version then you can
transfer it to another system providing you completely remove it from the
system you are selling.
 
You do not have to install Windows 98 to get to WinXP if you have a retail
copy of Win98. The only time you would need to install Win98 is if it is on
a restore cd and your WinXP is an Upgrade Edition. In that case you would
need to restore your computer to factory condition and then upgrade to XP.

If your Win98 is a retail cd then you only need to supply it when the XP
Upgrade installer tells you that it has not found a copy of Windows on your
computer and that you should now insert a cd with a qualifying copy of
Windows. The installer will verify that you qualify for an upgrade to XP go
on with the installation.

Of course, if your XP is a full edition you do not need Win98 at all.
