Kurt - fwiw, I see both of these posts, but maybe I downloaded them before

I guess I'm lucky my newsserver doesn't honor remove requests...

Wouldn't it be easy for them to sue Kurt or anyone else they thought
were in violation of their so-called EULA? MS has already been
convicted of various wrong doings not Kurt. Seems to me he's one of
the few people who post the truth not like the MS apologists or
certain "do nothing" MVPs who are afraid of losing their status.

Regards.

If MS sued everyone who had an illegal copy of Windows they would need years
to do it. It would also cost too much. In my opinion "Kurttrail" should
return his copy of XP if he breaks the contract he agreed to.

Don't own a copy of Windows XP. And MS, or any other software company,
has never sued one individual in the US over the "One Computer" term.
Once some company does and wins once, then the legal precedent would be
set. Until then, the "One Computer" term is nothing more than wishful
thinking.

He's such a small fish, he doesn't even show up on radar :-)

If MS wants to legally enforce their usage terms, then it's up to them to
sue me, if they don't, then they
have effectively & legally allowed my breaking of their usage terms.

Let's see you get into law school with that argument!

Kurt, you never cease to amaze! Kudos to you!

Wouldn't it be easy for them to sue Kurt or anyone else they thought were
in violation of their so-called EULA?

You say this as if they don't take violators of the EULA to court....The
thing is that there are litterally millions of them and it costs money to go
after each and every one, so you pick your battles...Do you go after the guy
who got you for $199.00 or do you go after the pirate who got you for
millions...You do the math.

I am not an MVP, nor am I a MS salesperson or even a MS advocate. I am an
advocate of the facts and separating fact from fiction.

Again, Kurt exposes his vast knowledge of how the legal system works.

And how many big fish show up on "radar?"

Many. Their called software pirates and MS spends millions each year trying
to counteract them. And yes, many of them do wind up in court.

You have, by your own actions, publically agreed to my reply-EULA terms.
Would it be legal for you to renounce me as your Lord & Saviour?

Fish would be tracked by sonar, not radar, numb-nuts.

And I would agree that all software pirates should wind up in court.
But installing a legally-purchased copy of software on more than one of
your computers isn't piracy. It's a breach of contract, and MS's only
legal means of trying to enforce it is by convincing a judge to rule in
their favor. And since MS has no legal right to know who purchases
copies of their software, let alone who has actually agreed to it, and
MS has no legal right to know what you do in the privacy of your home,
so it's highly unlikely MS would ever convince a judge to enforce their
post-purchase shrinkwrap license usage terms, on anonymous, private, &
non-commercial individuals.

Patent infringement. Anti-trust Violations.

Never had the Dept. of Justice on my ass!

You have yet to come up with one fact. Mostly you've said that I'm

You see, that's what I mean. Your statement has absolutley no basis in
fact. If you knew anything about how our legal system works, you'd know that
not pursuing litigation against someone is not an abdocation of your right
to do so in the future. It does not make the initial act legal.

My post is an attempt to impart some rudimentary understanding of what "law"
means and how its "enforcement" works and so, yes, I have indeed shown an
understanding of how our legal system works. This is not my opinion, this
is fact. There is no denying how our system of litigation works. 2 + 2
does equal 4.

Your response is nothing more than a childs "I know you are but what am I?".
Which, I guess, proves my point, so "thank you".

Show everyone the exact words where I advise the OP, John, to breach
anything! I told John that

You are so full of it!

LOL, you advise everyone every chance you get to do so.
Your full of it, and it is yourself.

DISCLAIMER (WARNING: PLEASE READ BEFORE CONTINUING):
"By posting another message to anyone, anywhere at anytime you admit that
you (Kurt) are a moron."

I hope you can live with my (according to you) legally binding discalmer
posted in a public place that I do not control or have any affiliation with.
I know that you will be ok with it because of the fee that you paid in order
to use this forum, or the registration form you filled out when first
accessing this server.

By the way, could you forward to me (and everyone else) the permission from
Microsoft to impose your legal restrictions on the use of thier servers?
Thanks so much, I just want to run it by my attorney.

resist.

know that not pursuing litigation against someone is not an
abdocation of your right to do so in the future. It does not make

So that would mean that it is now illegal to install legally purchased
software on more than one computer. PROVE IT, by showing some legal
precedent. If there is no law, or court decision that backs up that it
is illegal for an individual to install legally purchased software on
more than one computer, then it is merely your supposition that it is
illegal.
My post is an attempt to impart some rudimentary understanding of

You certainly have shown absolutely no understanding for contract law.

This is
not my opinion, this is fact. There is no denying how our system of

Prove it, if it is a fact.

I have laws and legal precedent on my side.
