Second hand copy of XP

Hi, I was wondering if I could use a second hand copy of windows xp (original
retail disk, bought off ebay) and register it for my use even if it has been
registered by the previous user.

Technically? Most likely.

According to the EULA - you should make sure the original user has removed
it from all previous installations.
 
There is no need to register since registration is optional.

Yes you can use it as long as you have the original Product Key and CD,
copies of either may indicate a pirated copy.
