OEM Software & Insurance in the UK

Hi

We have a number of machines with Windows XP and Office 2003 and a server
with SBS 2k3. All software is Dell OEM.

We are dealing with our office insurance quote, am I right in thinking that
the software is linked to the physical machine only, if we had a fire and
all the hardware was destroyed we would need to purchase new licences along
with the machines? We would be unable to request the Software Media and
continue on new machines without new licences?

You will need new licenses. Branded OEMs are forever tied to the first
machine.

Not quite true, and depends on what you mean by "machine" - if you were to
use just one screw from the burnt out machine - in theory the "new" machine
would be an enhanced version of the original...

Screws don't get destroyed by fire...

Well, if the Dells were replaced with identical Dells it might work. The
savings that Dell gives for not including the OS wouldn't make it worth
it, though.

Thanks, this is what I thought, I best insure the lot.

Its difficult to find a screw on a Dell machine :-) Tool free chasis, may
be able to find a spring or something!

You may be able to specify like for like insurance
eg If a Dell sys, supplied with OEM software is physically destroyed, then
the whole sys inc software would be replaced, on the basis that it is equal
or better than that origonally supplied
You are insuring a Dell sys that was supplied with OEM software, not a Dell
sys + software.
Read your Insurance proposal, T&C's, carefully or visit a Broker
 
Proportionally its not much..... Its the Professional Indemnity insurance
that's the killer!

We are specifying it in the agreement, just wanted to check that this was
the case.

We have an office full of lawyers, I will have one of them take a look
before signing :-)

"Software as a Component of the Computer - Transfer. THIS
LICENSE MAY NOT BE SHARED, TRANSFERRED TO OR
USED CONCURRENTLY ON DIFFERENT COMPUTERS.
The SOFTWARE is licensed with the COMPUTER as a single
integrated product and may only be used with the COMPUTER. If
the SOFTWARE is not accompanied by HARDWARE, you may not use
the SOFTWARE".

To access the EULA, got to Start > Run and type: WINVER
and then press the Enter key.
