Microsoft Removed My "Moduslink" Vista Disk From E-bay.

As the title says,i listed my brand new vista home premium disk (express
upgrade from moduslink) as i had already bought a new version .
They contacted e-bay and said the listing was illegal,but if you go to ebay
similar items are still for sell,so how do microsoft do this?
I have read other posts on selling and i can`t see why this is so called
illegal,is there an expert here who can enlighten me?
The item is still sealed with an un- used product key, as it was delivered
to me.

Well considering that your Moduslink Vista Disk has a OEM licence it is
illegal since an OEM licence is tied to one machine!

It is sorted now iv`e been allowed to re-list it,this time stating that it is
not a copy and it does not infringe mr big`s intellectul copy-right.

ok. i sold mine just says that it is an OEM and that u brought it but now
dont want it they wont remove it then. ok u do have to put in a compliant
piece of hardware. i put in a mouse 99p from Tesco good profit £10 s/h

Because you were illegally trying to sell an OEM license that was
already bound to your OEM computer. Doh!

What don't you understand? An OEM license is permanently bound to the
computer with which it was originally purchased. And Microsoft -- and many
other software vendors -- are constantly asking eBay to pull illegal sales,
such as yours. They just can't always catch everyone, and not all sales of
OEM licenses are necessarily as obviously illegitimate as was yours.

The item is still sealed with an un- used product key, as it was delivered
to me.

Irrelevant. The only reason you received that package is because you
promised to install it on the computer that qualified you for its receipt.

sir, may i tell you that i spent £220-00 on a retail version and installed it
on my computer.this because microsoft and moduslink could not organise a
p**s-up in a brewery.i was fed up waiting for the "express upgrade",i find
your tone pathetic, i have bought a retail version and an express upgrade
version both legally.so all i can say is UP YOURS.

I do have sympathy for the guy, I bought Windows XP Pro with the
upgrade coupon and I still have not received the upgrade. Everything
was approved and then when I checked a few weeks ago I was told the
order was cancelled at my request! I did no such thing. They told me
that they could not correct that (big lazy lie) and that I need to
resubmit everything and it would not change the shipping time. That
was good for a laugh! I resubmitted everything and I have not heard
back from them yet.

If Windows XP Pro did not come with the coupon I would have waited
until January 31st. I fully expected Microsoft to have the courier
here on January 31st with the upgrade. They should change their name
to Moneysuckers!

As it is I still have not opened the XP Pro package and if I do cancel
my order for the upgrade, the XP Pro package will go on to EBay.
