loading new xp over old unauthorized version

can I install xp as a rewrite over the old version which
I found was illegal, without losing my programs and data?

I believe that it is possible to do an in-place repair
installation if you have the full capability CD.

Boot from the CD and select install first, not repair. The
installer will find the existing installation and will then
offer a repair installation, which should keep installed
software, settings, and data. Select that.
