legal download of MS-Excel 2003

My Excel seems fritzed up. Besides it was Excel 2000 and I'm used to
2003 from work.

I see ver 2003 advertised for sale on craigslist. Is it legal to buy
one of these? If so, how can one tell?

Is it a download? If so I'd question the legality. A lot.
