Is this a legal copy of XP Pro?

This sounds like a good price on WinXP Pro. But is it a legal copy
of XP? Here's the link:
http://www.surpluscomputers.com/store/main.aspx?
p=ItemDetail&item=SWW13456

They say in their ad, "Condition: New

Warranty: 30 Days

Please Note: This is a fully functional original Microsoft CD with
installation key code and CD. On the CD it states you must legally
own a copy of their license to use this CD. This software installs,
fully activatable & registerable like the Commercial Versions you
find in the retail stores. This item is shipped in an
environmentally friendly packaging without the box.

This version DOES NOT come in a retail box. It comes with a CD &
Authentic Keycode for activation and registration. "

So I'm not clear - is this legal or not?

Looks legal to me; it's an OEM version of XP and the price is right. You
can also get the same thing at Walmart and NewEgg.

If it sounds too good to be true, it probably isn't.
If it's an OEM copy, it cannot legally be sold without being bundled with
hardware.
I wouldn't do it.

How can you tell, really? And isn't OEM not legal to sell if it doesn't come
bundled with hardware?

No, it isn't illegal. I have one XP Home Spanish on one machine, XP Pro
Spanish on another and XP Pro English on this one. All are OEM. All have
passed all the WPA/WGA/N nonsense and I didn't buy one piece of hardware
with any of them, not even a screw.

In the USA -- this *is* an international newsgroup -- you need to buy
some hardware with it so Walmart sells you a $5 mouse with it.

False. I have three legit XPs and none came with hardware.
I wouldn't do it.

I wouldn't either because I am not familiar with the store. You can get
the same price at NewEgg or Walmart.

This looks VERY shady. Getting a version of windows XP Pro for less than 125
is not common at all even with OEM. Also their description of the product
is...

SWW13456 - Microsoft Windows XP Professional Edition (NFR)

NFR signifies Not For Resale in which my company has a partnership status
with MS and we get NFR product all the time with our subscription. I believe
they have a holographic CD in a sleeve with a key code on the back like ours
come. I would not buy it at any cost as it will be a waste of your money in
the long run. Buy from Newegg and you will get a guarenteed good version for
only $30 or so more. Good Luck.

I suspect that this is an Enterprise edition of XP Pro which is sold by
Microsoft as a site license to a company. If this is infact the situation,
you may find that the "Authentic Keycode" will be no good for upgrades to
the software in the future. There are many companies that are selling the
Enterprise edition this way. This company's OEM version "comes with a free
mouse" and is priced at $139.99 versus the NFR version at 99.99. Don't
think you should use this company.

The requirement for hardware ended last August. Current OEM software can
only be sold in unopened packs to other system builders. Anyone who claims
to be building a system can be a system builder. They key point is they must
get an unopened OEM pack which has the System Builder license on it so they
will know exactly what their rights and obligations are. One packs are
available as are multipacks. Multipacks cannot be opened and the individual
units sold. If the software is shrinkwrapped and you can see the COA it is
from an opened multipack. Single packs come in a large brown softpack
envelope with many labels on it. Anyone selling anything different is
selling very old stock or they are breaking the terms of the System Builder
license.

For Alias, yes this may be different in other countries. I can only speak to
what I know of North American distribution.

Any scam artist can mail you an XP CD that they will warrant for 30 days.
