Is it illegal to customize startup flashscreen in XPE?

I believe most of us who plan to produce independent
embedded device with microsoft XPE wish for a customized
shell, a customized startup-screenfalsh, and if possible
a customized self-test processing screen.For myself i
want my final embedded device with XPE platform can not
been easily recognized by my customers that it is
obviously establised on windows platform. So i try many
ways to replace microsoft or windows logo in my XPE. Yes
i can use /noguiboot switch to hide them, but i expect my
product have a special startup screenflash.
So i use an interseting software BootXP which is widely
used in WinXP PRO to prepare a startup screenflash for my
XPE. BootXP make use of the NTOSKRNL.EXE and a bmp file
to produce a new LOGOOS.exe file to realize the startup
screenflash.
Who can give me some suggestions about if what i have
done is legal.
And if someone of you have succeed in doing this please
help me. because i can succeed in a CRT monitor and
always failed in a TFT LCD monitor with the following
error messeges:

STOP: C0000021A {FATAL system error}
The session manager initialization system process
terminated unexpectedly with a status of 0xC0000263
(0x00000000 0x00000000)

This is an old issue to change MS binaries and have a custom logo for your
XPe image.
You should contact MS legal department to resolve the issue. They should be
able to answer your question more precisely and legally correct.
