How Oems can be bought and used may be finally decide in court.

I was reading about Microsoft suing edirectSoftware for selling
pirated version.

Edirect claims the sell Genuine Windows Software even use the logos.

Also, on Edirect home page it refers to cases that shows this point.

I know a lot of people debate this claim. I don't want to get in that
debate.

We finally will find out if kurttrail, Alias and others are correct or
incorrect.

I don't think eDirect has much of a chance on this one, if the legal
reasoning ability displayed on the linked web page is any indication.
They incorrectly cite Procd, Inc. v. Zeidenberg as "showing how shrink
wrap licenses are not binding" when the case determined exactly the
opposite: Shrink Wrap licenses *are* binding legal contracts under the
Uniform Commercial Code, unless proven to violate pre-existing law or to
be "unconscionable."

Most of the remaining links that eDirect uses to "support" its position
are either irrelevant (not about software) or are links to many other
web sites and forums full of wishful thinking on the part of Open Source
advocates, rather than to real and pertinent legal decisions.
