windows xp reinstall reformat question.

I am using windows xp home with xp preinstalled before I bought my pc. If I
buy the windows xp home upgrade cd (retail) so that I can do a reformat
reinstall, can I use someone elses dell windows ME reinstall disk when it
asks to verify that the upgrade is an actual upgrade? is this legal?
