What makes a popup stay behind?

Does anyone know why some popups don't respond to
popping to the top of the window stack? That is,
when I get a popup sometimes, the popup window is
barely visible, but I can't get it to the top by
clicking on it. I have to click somewhere else
first.

I don't like it, but I curious as to how it works.
 
could be like a pop under that just waits untill you close
ie to show the ad of crap
