Upgrade from ME to XP

Can I use the OEM XP disc that came with my new computer
to upgrade my old computer OS from ME to XP?

1 - your oem copy is tied to the original computer it was installed on and
cannot be transfered or installed on another computer.
2 - oem copies only do clean installs, they do not do upgrade installs.

No, of course not.

First of all, OEM versions must be sold with a piece of hardware
(normally a motherboard or hard drive, if not an entire PC, although
Microsoft has greatly relaxed the hardware criteria for WinXP) and are
_permanently_ bound to the first PC on which they are installed. An
OEM license, once installed, is not legally transferable to another
computer under _any_ circumstances.

Secondly, as it has *always* been with *all* Microsoft operating
systems, it's necessary (to be in compliance with both the EULA and
copyright laws, if not technically) to purchase one WinXP license for
each computer on which it is installed. The only way in which WinXP
licensing differs from that of earlier versions of Windows is that
Microsoft has finally added a copy protection and anti-theft
mechanism, Product Activation, to prevent (or at least make more
difficult) multiple installations using a single license.

So don't you think that Bruce is a hypocrite for asking someone else,
"What specific case law and court decisions can you cite to support your
interpretation of the relevant laws," when Bruce can't even come up with
the specific "relevant laws" that backs up his own opinion, let alone
come up with "specific case law and court decisions" on top of that?
