I can't get a download od windows xp2 or whatever. Do I
need a subscrition to get it. Also (e-mail address removed) used my
credit card to set up his msn premium account without
getting my permission Do I need to call the police for you
to help me

These newsgroups have nothing to do with MSN. For that issue, yes, call your local police department. Also call your bank and have them turn off that credit card account, and issue you a new card. The offender won't get any more service as the card will be declined.
