The thing is Vista is alot more then the theme. Personally I don't think it
was right for that company to COPY the vista theme.

There are a number of sophisticated malware sites which mimic certain
Microsoft visual elements--the Security Center Shield, for example. They are
carefully designed to look "official" without actually having any wording
that claims to be a Microsoft site.

Microsoft has to be able to defend the artistic elements and icons in order
to be able to fight the really bad guys, I suspect.

I read what Jed Rose had to say--that's what brought to mind the spyware
vendors who are also "reusing" Microsoft icons.

They can't enforce unevenly--they have to go after everybody.
