If the live/remote site is on Unix/Linux, it sees image.gif and Image.gif as two separate files,
whereas when you try to publish back to your Windows machine, it sees image.gif and Image.gif as one
and the same file. To solve this problem, you need to rename one of the files on the live/remote
site before you can publish to your machine.

I have been getting the same error message when I have
tried to get the website to my own machine. I know the
person who maintained the site before me was able to
publish to her machine and then to live website. When I
took it over from her, I have been unable to put on my
machine at all..and have been working on live site for the
few changes/addtions. OH! and when I try to publish, the
error message is in conjuction with old files created in
2001 that are gifs. they have the same name and it won't
let me rename them..which is when I then get that error
message. Is this something I need to have resolved by the
host server? or is it something I can fix on FP??

If you are having problem on the remote server, then your
host has to fix extensions/permissions
related issues.
You can try open the site directly in FP on the remote
server, (if it has the FP extensions), and
run Tools | Recalculate Hyperlinks.
