Spell check has a feature that identifies repeated words (i.e. "the" "the")
and advises you of this error. Why dosn't this rule apply if I inadvertently
type "that" "that". Spell check does not identify this as an error.

Because the combination "that that" (like "had had") is not uncommon in
perfectly correct sentences.

There are legitimate sentences that contain "that that", for example:

"I wish that that question had an answer."

The developers chose to prefer a false negative (not flagging incorrect
usage) in this case rather than risking false positives (flagging correct
usage as a mistake).

Or for a laugh - punctuate

Smith where Jones had had had had had had had had had had had the examiner's
approval

Spell check ignores the first repeat, but, when correctly punctuated, the
above sentence has none of the pairs flagged as incorrect.
