....This happened to a friend of mine in the UK. He was going to return
the CD for a refund since he hadn't wanted the operating system anyway
but was told at the time he bought the comp he would have to have it
(the O/S) and purchase it. Does it sound right that he didn't recieve a
CD with the computer? I did when I bought mine and would have thought
that something wasn't right if I hadn't, since I had purchased the
software. Does anyone know if he has any legals rights to obtaining the CD?

Sounds fishy. My HP (with XP Home installed) came with an OEM version of
Windows XP Home, still shrink wrapped. I installed XP Pro on it. Thought
about selling the XP Home, but I don't know if I can legally.

Dude, they are smarter than that. If you don't want the purchaser pouring
paint on your car, keep the disk.

.you are confusing a retail off the shelf os from
microsoft with an oem version, you cannot move or sell an
oem version and you pay less for the os thru an oem.

so you save money when you buy it and you have a more
restricted product.

Makers are required, if they supply the system installed, to provide a
'means of restoring to ex-factory state'. Some (eg Hewlett Packard) are
doing this by providing the needed material on a hidden partition of the
hard disk, and you hit a hot key at boot to start the restore process.
Thus there is no CD. I regard this as highly unsatisfactory - all one
can do though is advise before the event that the buyer beware and check
- and not buy if that is the position
