Epson Lawsuit Update from Tyler Martin

I received an email regarding the effect of the Epson ink cartridge
lawsuit on compatible cartridge sales. Here is a copy of the email I
received from Tyler Martin who I have bought cartridges from for over a
year:

Epson Lawsuit

Starting last March TylerMartin.com began sending out
newsletters to our customers trying to keep them up to date on the Epson
Lawsuits. As many of you are aware Epson has filed against 24
manufacturers and distributors of compatible inkjet cartridges around
the world. This lawsuit also affects our Canon cartridge users as these
cartridges are made in the same plants as the Epson cartridges.

There have been many changes in the inkjet industry because of this over
the last month. Many of the manufacturers are no longer shipping into
the U.S. Our previous supplier is one of these manufacturers. Our
inventories of the Rainbow Brand & Nectron (USA) Brand are no longer
available in many of the cartridges we carry. The majority of the
cartridges we will be shipping over the next 2 months will be our G&G
Brand. We have purchased from them occasionally over the last 10 years.
Their prices were always higher than the 2 manufacturers we normally
purchased from.

With that said, effective August 31st we will no longer be
able to offer the good ole “Rainbow Brand Bundle Pricing” on any of our
compatible ink cartridges. The next phase will be adjusting our single
cartridge prices. This will begin around the middle of September. We
wanted to give our loyal customers the next two weeks to stock up on the
(never to be seen again) Rainbow brand prices. As we restock each
cartridge model with the G&G Brand, we will have to change the prices
accordingly. You can click on the G&G link on the website to get an idea
of what the prices will go to.

There will be a ruling in October by the courts and we at
Tyler Martin feel it will go in Epson’s favor. I’m not much on the legal
stuff but it sounds like there will be an “injunction” which will no
longer allow the so called “patent infringing ink cartridges” into the
United States.

Our G&G Plant is one of the only 2 plants that we have
found that now has “non-patent infringing products” that have been
cleared for sale in the United States. The cartridge designs are very
different and we are still negotiating prices. Watch your email or
visit our website for further updates.

FYI: Canon also appears to be getting in the game now.
They have 2 new lines of cartridges out now. One of them uses the
printhead on the cartridge, and the other uses an ink level chip. Patent
laws protect both of these. We will be watching them closely to see if
any legal issues develop."

Sounds like it is not their plant since they have to negotiate prices. :-D
is one of the only 2 plants that we have found that now has

the United States. The cartridge designs are very different and we are

The better printers use the chip in an ink cart with a separate printhead
Patent laws protect both of these.


Aw Comeon, the designer engineer who did all of the R&D deverve to have
patent protection.
