Driver compatibility with full install of XP not upgrade

Kodak claims, and it appears to be true from my tests, that their driver for one of their discontinued film/slide scanners works only with a full intall of windows XP not a "upgrade" over windows 98. I didn't believe it in their release notes and did the upgrade so I wouldn't loose all my configuration settings. Does anyone know why this could be the case? Are their any registry tweaks that could help? Will a "repair" of the installation yield an installation similar to a full original installation?
 
An addendum to my earlier note: using XP home. Here are the exact words from Kodak: Note WINDOWS XP Home Edition: Your system must have
a New Installation (option on the WINDOWS XP Upgrade Version
CD-ROM) or a Full Installation (WINDOWS XP Full Version CD-ROM)

BTW, their tech support people are clueless about this. Thanks
