If the said charity handed the goods to people under the restriction that
they are not used to make money with, it is a violation of their TOS, and
yes, this can make such behaviour illegal. Legally, a donation is a
contract, and if there are are any conditions broken in the aftermath, you
have violated some laws, at least in Germany, where a donation is a kind
of "unilateral exchange", both do agree on it, and so it is a contract,
altoghether with its conditions.
If your granddad gave you money and told you to spend it on good books,
and you bought some liquor instead, he would have all the right to be
pissed off. As a relative, he won't sue you in court; but it still ain't
right.
