When I use then context menu handler to open with on
a .vbs file; the spy ware popup shows up. When I click
OK, the vb script executes even though I selected an
editor to open and edit the file (not the Window based
Script Host).

Yes--you've accurately described a serious bug in the current beta product.
Additionally, the script executes with the current directory context of
\system32.
