Desktop folders

I downloaded some digital pictures and put them in
folders on the desktop in order to then burn them onto a
CD. When I tried to delete them from the desktop, the
pictures in the folders deleted but the folders wouldn't
delete, instead I got the message "Cannot delete. It is
being used by another person or program. Close any
programs that may be using the file and try again.

No one else is using these and there is no open program.
How can I delete these folders?

Reboot and try again, if that does not work, create a new user and use
that account to delete the folders from the original profiles desktop
folder.
