upgrade problem

I just installed a new hard drive. I copied the old drive with xp home to
the new drive using Western Digital software that came with the drive. I am
trying to upgrade to vista basic home on the new drive. I receive an error
message stating I can only do a fresh install because the old operating
system doesn't support an upgrade. How is this possible, windows xp
home>vista home basic ?

Because you changed the HDD which now means that the XP Home
installation is no longer activated and doesn't pass the WGA test. You
can only perform an upgrade on an activated XP install that passes WGA.
 
even though I copied the old drive to the new one? is there any way to do this
