it sounds like i have the same problem
if my modem isnt turned on when the machine boots, XP thinks the modem isnt there
but it knows what moden is installed

in control panel goto modems
click add, and then next

let it search for only a few seconds then click cancel
then finds the modem
i thought SP1 was going to fix this.... but no

I'm afraid you'll need to contact AOL's tech support for resolution
of problems with (or caused by) their product; Microsoft has no
control over AOL's product quality (or lack thereof).

Did your old OS come with a CD for the Phone and Fax modem and did you
install it on XP?
That's what I did after my upgrade.
