I have some lengthy legislation that I have formatted. In some areas
it is conducive to setting up headings and outlines, in some it is not
- for example explanatory test that should not be part of the heading
appears on the same line.
Sometimes the opening phrase of the paragraph is not the entry I want
in the TOC - so that rules styles out.

What would be another good way to create a TOC?

Note that you can use TC (table of contents entry) fields and XE (index
entry) fields in the same document.

I don't understand the question. What does the index have to do with the
TOC?
