Recycle bin problem

After burning pictures to a cd, the files were moved to the recyle bin, however, some of them will not delete and this is causing the rest to not be deleted. The message says "this file dc1113 cannot be deleted because it is in use by another person or program" Also, lots of copies of these files are bing put back on the hardrive when sending to the recyle bin - HELP!!!!!
