My table of contents insists on starting with 2 instead of 1

I am trying to insert a table of contents for a document, but when I run the
ToC it starts at 2 instead of 1, any suggestions what I am doing wrong? I
have re-marked the document 3 times with ToC markers and still it starts at 2.
 
Page 2 or Chapter 2? If the latter, do you have a manual page break before
the first heading?

What I meant was, I was working on a legal document which has section
headings and subheadings, when I run the table of contents, instead of
starting with Section 1, it starts with Section 2, for example....

should read:
1. Definitions.
1.1 Act.

instead it shows:

2. Definitions
2.1 Act.

I am just not sure why starts with 2 instead of 1. This happens
occasionally and I am never sure why it is happening.
 
My guess is that you have a manual page break before the first heading.
Substitute "Page break before" in the paragraph formatting.

Select the Definitions paragraph. Go to Format > Bullets and Numbering. Set
the 'Start-at' value to 1.
 
Thanks Jezebel but that is pretty standard for creating a table of contents
and of course I did that and rechecked it, but thanks for input.

Suzanne, I have no manual breaks in the documents and only section breaks
where I always put them. I did manage to make the ToC work late yesterday by
reformatting the document. This has happened in the past a few times and I
am never sure what the problem is with it, but reformatting usually works it
out but is a long process for a 45 page legal document. Could it be hidden
formatting of some kind that I miss?
