Microsoft XP Pro / PC Sale

I work for a mid size company that is downsizing. We
have many Compaq Deskpro 350's, 400's, etc. that we want
to sell to employees. The machines came with Win 95 that
we've since upgraded to Windows XP Pro via our Enterprise
Agreement.
MY QUESTION IS; Is it legal for us to sell these 5 year
old PC's that belong to the company to employees with the
XP operating system on them?

Hi, Steve.

Why would you ask that question HERE? This is a peer-to-peer newsgroup
(called a Discussion Group in the Web-based interface). In other words,
we're just users like you. Most of us don't work for Microsoft and have no
authority to speak for Microsoft. (And few of us are lawyers, so we can't
legally answer the "is it legal" question.)

Read your Enterprise Agreement. Most likely, it shows a phone number or
website URL where you can get an official answer to your question.

No, the license belongs to the company and cannot be transferred
to individuals. You'll have to reformat the hard drives before
selling them.

Answers to your questions can be best addressed by reading
your Windows XP End-User License Agreement. You can
access it by going to Start > Run and type: WINVER , and
hit enter.

Just donate them to charity & take the tax break. There are
all kinds of Security & Licensing issues. It's been a while
since I was a Corporate IT drone, but Enterprise licensing
doesn't transfer if the companies property is sold to private
individuals. Especially, since they won't be used for company
business.

Then you've got the issue of company documents,etc on
the PC's. No matter what you do with them, I would do a
security erase on the drives.

With full systems selling at $500, you really don't want the
headaches of employee's coming back to IT with every kind
of install/configuration & use issues.

Just an opinion, but I've "Been there and done that".

The charities will bug you forever.

A well-known medical center in Rochester has found the perfect solution for
the 75-100 PCs they replace each year.

They put them on the curb for the urban faeries.

Dilbert puts his old machines in a schoolyard at night (his boss put his old

Safest route would be to put the original Windows 95 back on the
machines and sell them that way.

350 and 400's, you will have to pay someone to haul them off
unless you have some really really out of the loop employees.

Sure you can sell the PCs with XP on them. I wouldn;t tho. I'd wipe the
drive and sell
the pc with no OS.

Hey, watch it. I just bought a 400 P2 less than a year ago, and
paid $94 for it. Those boxes are still hot commodities. :-)
 
FYI,

I don't think you can sell regardless of software licensing issues. when you sell it (you are taking profit) and if the company finds out, you can be in trouble. The was a case with an employee in ATT (sold old useless part over Ebay) and got caught and procecute. I would make it for personal use or give it away to charaity?
