lbl not showing up?

So I got the lbl to not be over the subreport, but now the lbl won'
show when the subreport has no data and is not visible. An
thoughts

In report design view, cut the label from the subreport (to clipboard).
Then click the (Detail?) section header (the grey bar), and paste.
Move the label into position.

The unattached label should then appear.
