Is sygate spyware?

I monitor what goes on in my computer net with active ports ( free
ware, at snapfiles I believe)

Recently I looked at it as sygate personnal firewall was coming on
line during start up. I found the sygate service (smc) has 2 udp
connects, that I expect for it to do its work, and one remote TCOP
connect, that disappears shortly after startup (x.x.x.x is my router)

Here is the active ports result

Process/ PID/Local IP/Local Port/ Remote IP/ Remote port
udp smc.exe 408 127.0.0.1 1028 LISTEN UDP
udp smc.exe 408 0.0.0.0 1025 LISTEN UDP
tcp smc.exe 408 x.x.x.x 1030 207.33.111.82 8195
ESTABLISHED TCP

The disturbing part is the third line which disappears shortly after
startup. It appears that sygate is phoning home.

Can anyone shed light on this?

Thanks

I looked for that option, and sure enough it was checked. When I told
it to search for options, it checked the same place

You nailed it, I unchecked the option, and it no longer phones home on
startup. You'd never know it was calling home unless you monitored it
with some other program..

It brings to mind the following koan

why do ducks have webbed feet?
to put out forest fires
why to elephants have big flat feet?
to put out burning ducks

Sygate is one of many customers of Verio. I used to do tech support
for Verio and we got at least one call a week from someone with Sygate
firewall claiming they were "being hacked" by Verio.

Probably because sygate... which tells you every other damn thing tha
it connects to, does not tell you about this connect. I love the
program... but a persistent problem like this might just possibly
suggest that the design choise is wrong.

Every other connect you after a clean install you have to approve. Yet
this one thing is installed by default, and you have to figure it out
for yourself that auto update is a default rule
