You can upgrade to XP Pro using the standard XP Pro Upgrade kit.

If you have a full retail or upgrade XP Pro CD, you will be able to
upgrade your existing system without losing anything. If you have an
OEM XP Pro CD, the only way to install it is to delete the existing
OS.

No problem to upgrade from XP Home to XP Pro when using a Retail-CD.
As usual, you should backup important data before. Trying to upgrade
WinXP using a SB-CD usually doesn't work.

Assuming the version of XP Pro is not an OEM version designated to be
installed only on a new system or blank hard drive, yes, you can use it to
upgrade from Home to Pro.

Note, given that you've said you have important software installed,
understand, that will the process of installation is easy from the user's
point of view, this is still a major operation. Do not do this unless you
are well backed up meaning you have backed up anything you don't wish to
lose including your data files. You should have installation CDs for your
applications, if not, you may need to image the entire drive to be sure you
have it protected.

This is usually a fairly painless and seamless operation that goes without
incident but things can and do go wrong, make sure you protect yourself
before proceeding.

well, is a oem. so i can't do anything? the update can't be done legally via
internet?

Carlos;
As far as upgrading, legality has nothing to do with it.
Generally OEM is incapable of upgrading.

Also generally OEM is permanently tied to the first computer installed and
may not be transferred to another computer regardless the condition of the
original computer.
Read the specific EULA for details.
If the OEM has never been a part of another computer at all, you can use it
to perform a Clean Installation.

Carlos;
When you say update, are you really meaning upgrade Windows XP Home to
Windows XP Pro?
If so, that can not be done on the internet.
You need a retail CD to perform the upgrade.

If you mean the Windows Updates for all the security updates, yes you get
those online through the internet.

Why do you want to upgrade to XP Pro?

There is zero difference in performance or stability between Home and
Pro and both versions are compiled from the same source code base.

The only differences between the two are certain functions and
features which are included in XP Pro but which are not found in XP
Home. Unless you have a known or anticipated need for at least one of
these functions and features which are unique to XP Pro there is no
need to or benefit in doing the upgrade.

Good luck
