China.

The following information is what I get from a Chinese newsgroups and a
Chinese IT forum.
And I'm pretty sure that the information below will be widely available to
the Chinese PC users shortly.

you with your learning cuve but let me lay it out for your first. Rob is

famous blogging and speaking while at MSFT and has produced many of the
excellent MSDN Radio 9 videos on MSFT and the making of the lip stick pigged
Vista. Rob Scoblle quotes Rebecca McKinnon's stories and they are linked
here. Hundreds if not thousands of occurences like this are the direct
result of Microsoft and specifically the cowards at MSN who are paid
millions in stock options. Again two of them have Inidan backgrounds not

in question. What I think would surprise Mr. Gates who is admirably focused

Currently they are refusing to share information in many areas regarding
Pandemic H5N1 flu strains, vaccination failures in chickens, and other
essential info.

If Gates and MSFT were merely selling to China, and had not been not
facillitating the torture and killing of Chinese students and other citizens
by turning over their MSN web searches to the government. However MSN Live
VP Debra Charapaty hired in April 1, 2003 and Yusuf Mehdi whose title has
currently morphed into Senior VP and Advertising Strategest after passively
watching his subordinate berate a female employee who was written up in the
WSJournal a couple weeks ago for years as "stupid"only to adopt her

coiincidently is Chinese but Mr. Ballmer knows how it worked during the
Holocaust as do the rest. Elements of the Holocaust are alive and well in
many countries now, including the US, but they are particularly robust and
vibrant in China and Russia is allowing them to grow.

I would think that people should be encouraged to use whatever features Win
Mail or OE offers since the company MSFT has not lifted a finger under John
Eddy to improve the shell experience or internet experience of the html
community site aka the horrible web community experience with its clunky
limited message downloads and horrendous features. Know any Shell MVPs?
Ask them why they haven't lifted a finger to improve the horrendous
experience of the html web interface which people have been using in droves
here, probably because they haven't been able to take the 10 seconds max it
took to configure the OE wizard back in the ancient XP days, and because
they haven't figured out how to click on Communities in Win Mail.

When people resort to blocking and censoring posts, one might have to resort
to whatever means to stop the censorship.

Richard--next time you're in Redmond--April for the next feed the MVPs swag
so we can keep them as syncophants round of meetings can you find out why
there is so much self-righteous Saturday Night Live Church ladyesque
hysterical hand wringing by the MVPs over the prospect of piracy when the
huge bulk of it will occur via street corner sales in Asian countries and
MSFT will have little control over it?

If you think there are conspiracy theories as to Chinese repression, try
going there as the NY Times did and reporting what you see and watch how
fast your ass is thrown in jail on trumped up spy conditions where you won't
have a chance--not a far cry from the sitaution that's evolving in the
justices system in the states however, particularly since the idiot law was
passed allowing the gov to use heresay evidence from paid snitches pushed by
Bush which will soon be repealed by the new Congress in control.

It was renounced by the ABA and every law school faculty.

Your denial of repression in China reminds me of the airbrains who get their
talking points from Rush and are now spouting that "democracy takes time."
The quick way to jolt them into silence is to ask them why they aren't in
Iraq to hel with it and how long it will take before they get there.

There was no conspiracy theory as to Microsoft lying to their own employees
about saving customer searches or lying to the public but there have been a
chain of tortured assurances that the lying wouldn't happen again with no

Chinese Court Rejects Appeal by Researcher for The Times

BEIJING, Friday, Dec. 1 - A Beijing appeals court on Friday upheld a fraud
conviction against a Chinese researcher for The New York Times in a ruling
that means he will probably remain in prison until his three-year sentence
ends next September.

The researcher, Zhao Yan, sought to overturn an August fraud conviction that
stemmed from a period in 2001 when he worked as a reporter for a Chinese
magazine. He has maintained his innocence, and his legal team has complained
that the appeals court prohibited them from mounting a vigorous case.

Witnesses inside the High Court of Beijing said the judge called the case
shortly after 9 a.m. on Friday.

"Do you have anything to say?" the judge asked Mr. Zhao.

"What kind of judge are you?" Mr. Zhao answered, according to the witnesses.
"Is this how you use the power the country gave you?"

Outside the courtroom, Guan Anping, a lawyer for Mr. Zhao, criticized the
court. "Zhao Yan wasn't given the opportunity to testify in court," Mr. Guan
said. "He was not allowed to call witnesses or present certain evidence.
They sustained the verdict without having another trial. The verdict was
based only on the written materials."

The case of Mr. Zhao, 44, has attracted international attention while
raising questions about the rule of law and press freedom in China. Mr. Zhao
was initially charged with leaking state secrets to The Times, which could
have meant a prison sentence of more than 10 years.

The charge was linked to a September 2004 article in The Times, which
reported that former President Jiang Zemin had unexpectedly offered to step
down as chief of the military, his last leadership post. The Communist Party
bars Chinese news organizations from reporting on high-level politics, and
the Times article, based on anonymous sources, quickly prompted a high-level
government investigation to determine the source of the leak.

Mr. Zhao joined the Beijing bureau of The Times in April 2004, after working
as an investigative journalist for different publications. He was arrested
less than two weeks after the publication of the Times article in September
and accused of being a source for the article, which both the newspaper and
Mr. Zhao have denied.

His trial was held last June, but a verdict was delayed until August, when,
in a surprise, the lower court dismissed the state secrets charge. But Mr.
Zhao was sentenced to three years on a lesser fraud charge that
investigators added a few months after his initial arrest in the state
secrets case. The two charges are unrelated, and some legal analysts have
questioned whether investigators added the charge as a move to save face.

The fraud charge involves an accusation against Mr. Zhao by a minor official
in Jilin Province. The official claimed that Mr. Zhao had taken a cash
payment in exchange for promising to use his position as a journalist and
his political influence to help the official avoid serving in a forced labor
camp. Mr. Zhao has denied the accusation and has said that all of the
witnesses against him are friends or relatives of his accuser. Mr. Zhao has
already spent more than two years in prison and is scheduled for release
next September. His lawyers say that his health has worsened.

On Thursday, Jiang Yu, a spokeswoman for China's Foreign Ministry, was asked
during a regular news briefing about Mr. Zhao's case and the larger question
of press freedom in China. "China is a country of rule of law," Ms. Jiang
said. "This case has always been dealt with according to Chinese laws and
legal procedures."

I don't see how I am shooting any messengers, unless you mean MSN Messenger
or MSN Live anything there is on the growing list, which also gathers your
data and is turned over to governments. I didn't say Colin Barnhorst is
repressing people in China. I didn't say that Janet or Mike or although I
suspect it has to be painful for anyone named Janet Chen to know the country
where their parents and grandparents might have been born is behaving in
Nazi fashion.

Certainly China's behavior and the United States' poor organization along
with the WHO and CDC in not reigning them in has created a much greater
threat to Colin Barnhorst now from a pandemic disease for which there is no
cure and no prevention curently.

China has done very little to prevent it and a lot to promote it because
they have no control over reporting, organizing, innoculating chickens.
Intriguing China is doing $1.5 billion dollar deals with MSFT while many of
its villages with no running water or electricity are allowing H5N1 to
spread and kill and its reaching Europe and soon the US.

So maybe if we get a quad core on every farmhouse table, that will be the
ticket.

Tamiflu makes it worse. Why are your neighbors buying out the local
pharmacies then? Ignorance.

Why are state governments spending money stockpiling it. Ignorance.

If by the messenger, you mean MSFT how explicit can I make it. Read the
links I gave you. MSFT climbed in bed with the Chinese government and
became a willing participant in identifying web searches via MSN Search,
turning them over to the Chinese government so that they could seek out and
torture and jail and kill people whose blogs they didn't like, people whose
surfing habits they didn't like.

That would be enough to make me vow never to subscribe to msn anything.

MSFT and MSN have been willing puppy dogs in turning over their customer
data to the US government. Have a passport to sign into Connect? Giddy
that you're getting the latest Beta information that Bozo down the street
doesn't have because you're chosen? All that info is being compiled by MSFT
and turned over to a repressive out of control DOJ.

They have one policy for the public eyes, and another in reality. MSFT has
become a willing shill and agent for the Chinese government's ability to
torture and its own US government's ability to do the same thing.

I don't see how in the world I'm shooting any messenger. MSFT isn't a
messenger in any of this Chinese or US based repression. They are a willing
participant.

As to WGA and SPP, and all this absurd convoluted MVP angst and breast
beating and wailing and hand wringing over pirated copies that's intriguing.
OEM system builders may be hurt by piracy, although it's not being
controlled a scintilla in Asia and many countries beyond the US and
certainly won't be by the kill switches which will be promptly hacked--you'd
really have to be naive to think they can't and won;t.

It's very simple. MSFT is erratic when it comes to software and all this
Brannigan crap about how robust WGA and SPP are skirt one point. They are
wrong a huge amount of the time. So let the class action law suits on them
begin, and they have and it will follow the usual scenario there of MSFT
backing down, hemorraghing money, sigining cost consent agreements, and the
lawyers on both sides will have made more money.

The FBI appears to have begun using a novel form of electronic surveillance
in criminal investigations: remotely activating a mobile phone's microphone
and using it to eavesdrop on nearby conversations.
The technique is called a "roving bug," and was approved by top U.S.
Department of Justice officials for use against members of a New York
organized crime family who were wary of conventional surveillance techniques
such as tailing a suspect or wiretapping him.

Nextel cell phones owned by two alleged mobsters, John Ardito and his
attorney Peter Peluso, were used by the FBI to listen in on nearby
conversations. The FBI views Ardito as one of the most powerful men in the
Genovese family, a major part of the national Mafia.

The surveillance technique came to light in an opinion published this week
by U.S. District Judge Lewis Kaplan. He ruled that the "roving bug" was
legal because federal wiretapping law is broad enough to permit
eavesdropping even of conversations that take place near a suspect's cell
phone.

Kaplan's opinion said that the eavesdropping technique "functioned whether
the phone was powered on or off." Some handsets can't be fully powered down
without removing the battery; for instance, some Nokia models will wake up
when turned off if an alarm is set.

While the Genovese crime family prosecution appears to be the first time a
remote-eavesdropping mechanism has been used in a criminal case, the
technique has been discussed in security circles for years.

The U.S. Commerce Department's security office warns that "a cellular
telephone can be turned into a microphone and transmitter for the purpose of
listening to conversations in the vicinity of the phone." An article in the
Financial Times last year said mobile providers can "remotely install a
piece of software on to any handset, without the owner's knowledge, which
will activate the microphone even when its owner is not making a call."

Nextel and Samsung handsets and the Motorola Razr are especially vulnerable
to software downloads that activate their microphones, said James Atkinson,
a counter-surveillance consultant who has worked closely with government
agencies. "They can be remotely accessed and made to transmit room audio all
the time," he said. "You can do that without having physical access to the
phone."

Because modern handsets are miniature computers, downloaded software could
modify the usual interface that always displays when a call is in progress.
The spyware could then place a call to the FBI and activate the
microphone--all without the owner knowing it happened. (The FBI declined to
comment on Friday.)

"If a phone has in fact been modified to act as a bug, the only way to
counteract that is to either have a bugsweeper follow you around 24-7, which
is not practical, or to peel the battery off the phone," Atkinson said.
Security-conscious corporate executives routinely remove the batteries from
their cell phones, he added.

FBI's physical bugs discovered
The FBI's Joint Organized Crime Task Force, which includes members of the
New York police department, had little luck with conventional surveillance
of the Genovese family. They did have a confidential source who reported the
suspects met at restaurants including Brunello Trattoria in New Rochelle,
N.Y., which the FBI then bugged.

But in July 2003, Ardito and his crew discovered bugs in three restaurants,
and the FBI quietly removed the rest. Conversations recounted in FBI
affidavits show the men were also highly suspicious of being tailed by
police and avoided conversations on cell phones whenever possible.

That led the FBI to resort to "roving bugs," first of Ardito's Nextel
handset and then of Peluso's. U.S. District Judge Barbara Jones approved
them in a series of orders in 2003 and 2004, and said she expected to "be
advised of the locations" of the suspects when their conversations were
recorded.

Details of how the Nextel bugs worked are sketchy. Court documents,
including an affidavit (p1) and (p2) prepared by Assistant U.S. Attorney
Jonathan Kolodner in September 2003, refer to them as a "listening device
placed in the cellular telephone." That phrase could refer to software or
hardware.

One private investigator interviewed by CNET News.com, Skipp Porteous of
Sherlock Investigations in New York, said he believed the FBI planted a
physical bug somewhere in the Nextel handset and did not remotely activate
the microphone.

"They had to have physical possession of the phone to do it," Porteous said.
"There are several ways that they could have gotten physical possession.
Then they monitored the bug from fairly near by."

But other experts thought microphone activation is the more likely scenario,
mostly because the battery in a tiny bug would not have lasted a year and
because court documents say the bug works anywhere "within the United
States"--in other words, outside the range of a nearby FBI agent armed with
a radio receiver.

In addition, a paranoid Mafioso likely would be suspicious of any ploy to
get him to hand over a cell phone so a bug could be planted. And Kolodner's
affidavit seeking a court order lists Ardito's phone number, his 15-digit
International Mobile Subscriber Identifier, and lists Nextel Communications
as the service provider, all of which would be unnecessary if a physical bug
were being planted.

A BBC article from 2004 reported that intelligence agencies routinely employ
the remote-activiation method. "A mobile sitting on the desk of a politician
or businessman can act as a powerful, undetectable bug," the article said,
"enabling them to be activated at a later date to pick up sounds even when
the receiver is down."

For its part, Nextel said through spokesman Travis Sowders: "We're not aware
of this investigation, and we weren't asked to participate."

Other mobile providers were reluctant to talk about this kind of
surveillance. Verizon Wireless said only that it "works closely with law
enforcement and public safety officials. When presented with legally
authorized orders, we assist law enforcement in every way possible."

A Motorola representative said that "your best source in this case would be
the FBI itself." Cingular, T-Mobile, and the CTIA trade association did not
immediately respond to requests for comment.

Mobsters: The surveillance vanguard
This isn't the first time the federal government has pushed at the limits of
electronic surveillance when investigating reputed mobsters.

In one case involving Nicodemo S. Scarfo, the alleged mastermind of a loan
shark operation in New Jersey, the FBI found itself thwarted when Scarfo
used Pretty Good Privacy software (PGP) to encode confidential business
data.

So with a judge's approval, FBI agents repeatedly snuck into Scarfo's
business to plant a keystroke logger and monitor its output.

Like Ardito's lawyers, Scarfo's defense attorneys argued that the then-novel
technique was not legal and that the information gleaned through it could
not be used. Also like Ardito, Scarfo's lawyers lost when a judge ruled in
January 2002 that the evidence was admissible.

This week, Judge Kaplan in the southern district of New York concluded that
the "roving bugs" were legally permitted to capture hundreds of hours of
conversations because the FBI had obtained a court order and alternatives
probably wouldn't work.

The FBI's "applications made a sufficient case for electronic surveillance,"
Kaplan wrote. "They indicated that alternative methods of investigation
either had failed or were unlikely to produce results, in part because the
subjects deliberately avoided government surveillance."

Bill Stollhans, president of the Private Investigators Association of
Virginia, said such a technique would be legally reserved for police armed
with court orders, not private investigators.

There is "no law that would allow me as a private investigator to use that
type of technique," he said. "That is exclusively for law enforcement. It is
not allowable or not legal in the private sector. No client of mine can ask
me to overhear telephone or strictly oral conversations."

Surreptitious activation of built-in microphones by the FBI has been done
before. A 2003 lawsuit revealed that the FBI was able to surreptitiously
turn on the built-in microphones in automotive systems like General Motors'
OnStar to snoop on passengers' conversations.

When FBI agents remotely activated the system and were listening in,
passengers in the vehicle could not tell that their conversations were being
monitored.

Malicious hackers have followed suit. A report last year said Spanish
authorities had detained a man who write a Trojan horse that secretly
activated a computer's video camera and forwarded him the recordings.

Let me spell it out for the MVP. Computers do searches. Microsoft turns
them over to governmetns who in the case of China go out and arrest, torture
and kill people who do searches that government doesn't like. Microsoft
could have refused to turn over the searches. Read on. Glad to provide

Life is so good when one can glean the pearls from such euridite, well read,

So Robert Simpson wants the world to know "Chad we know it's you." At what
age did you reach the ability to say that? 2 or 3?

1) I know a lot about MSFT. I know a lot about their OS. I've said
repeatedly but you're too stupid to read it I don't in any stretch "hate
MFST." But we all understand monocrhomatic little minds--they are pandemic
in my country who think criticism of MSFS is tantamount to hating it.

2) Every last point I make is butressed with facts, links and accuracy.

I rarely resort to calling names, but in your case I'll recognize a stupid
post. I am fixing Vista entities and components right and left in RTM on
groups that I bugged and many others bugged during the Beta. They did
nothing to fix them which raises the question what the hell was MSFT paying
these PMS and developers for.

3) Since I can use the Windows OS a lot better than you'll ever be able to,
I'd worry about what OS's you want to install.

4) You give orders to how many people in your little world? Imperatives are
an oxymoron with Robert Simpson because there is no one on the planet who
takes orders from you and lol not strangers in a news group. I don't recall
a service contract for Robert Simpson and my boxes.

5) A search on Robert Simpson in this group and others yields nothing
substantive in the way of a fix or tweak contribution. Why would that be?

6) I make no bones about trying to help people use MSFT software and if that
puts money in their pockets, that's not my concern. I don't define my
activites by whether I put money in a large companies pockets.

I've said many times the reason I help is that MSFT pisses on their
customers by providing terrible subenterprise support outsourced by
Convergys of Ohio to India. It is not because they are in India, it is
because they are people in India poorly trained. It is because Microsoft is
cheap when it comes to customer care and support, and Convergys is a
terrible company providing terrible service like a proportion of the legions
of oranga badges and blue badges MSFT employs.

A search for Robert Simpson on this group reveals not one contribution. Why
don't you spend a couple hours trying to find a start button? That'd be par
