Can anyone tell me is this is legitimate?

I suspect that it is not a good buy...
One, if you buy it you are encouraging SPAM
Two, it may be pirated
Three, they may take your money and deliver nothing and do
you know how to get your money back from Russia, Chine or
where ever. Do you even know where is?

They forgot to mention...

You don't get Microsoft support. MS will refer you to the OEM when you quote
an OEM serial number..

Typically you can't move OEM versions to a new computer when you upgrade
your PC.

I got the same solicitation and was wary of it for much the same reasons the
other respondees indicated. However, OEM versions of software can be
valuable. For example, I bought XP Home (SP1) from an eBay vendor for
$50.00. It has worked great and there was no registration problem. The "OEM"
hardware was a cheap internal modem which I tossed. It's a crap-shoot, but
at least on eBay you can check the seller's feedback and excoriate the
bastard if he's a fraud.
