Access to Denied to movies folder

Due to unremovable spyware i recently reformated my C and
D drives which contain my windows files and program files
respectively. After reinstalling windows i tried to
access some of my files on my E: drive and i get an error
message saying "access Denied". I know i didnt reformat
this partition because the folder is 3 deep in other
folders that contain documents. When i ID the folder it
says it contains 0 bytes but the hard drive says that the
space is still occupied. Any ideas how i could recover my
files?
