XP Professional Partition woes

trying to perfrom upgrade only for Windows XP and get error
which trying to install on a current partition. I get the
following error:

Windows XP cannot recognize the partition you selected.

Setup cannot install Windows XP on this partition. However,
you can go back to the previous screen, delete the
partition. and then select the resulting unpartitioned space.

Setup will then create a new partition on which you can
install Windows XP.

I do not want to lose the data if I can avoid it, because I
have some software I do not have the CDs to reload. I am
upgrading from 2000.

Apparently you acquired an "OEM Version" of Windows XP Professional.
OEM versions cannot upgrade an existing Windows installation. Only
"retail versions" can upgrade. Either purchase a retail version of XP Pro
or reformat your drive to install the OEM version.

Anyway to know for sure? I am helping someone who got the
CD from their IT department to do the upgrade. My friend
works remotely so IT could not do it directly. Although I
did not speak directly to the IT person, I did get the
impression that this CD had been used to perfrom an upgrade
in the past. It does offer the choice of Upgrade or new
install when I run the setup from windows. Microsoft also
comments on the drive type with this error (Dynamic disk)
is there a way I can check to see how my drive is setup?

Windows XP cannot upgrade over a "dynamic disk".
Someone evidently converted the Windows 2000 partition to dynamic.
Only way to correct the problem is to delete the dynamic
disk partition and create a new partition.

I just confirmed that the drive is basic and I am 99% sure
the CD is not OEM version? Any other ideas?
