"Then that would seem to prohibit hard drive upgrades"
Not at all, I fail to see where you get that from.
Replacing the hard drive is simply another type of upgrade.

Brian's interpretation of the EULA was as follows, "According to the
EULA, the 'licenced device' is the partition (ie HDD) that Vista is
installed on."

If we accept that interpretation, then hard drive upgrades would be
prohibited.

Here's a news flash... smarter people reject 99% of what the MVP crowd
blusters in newsgroups like this because they have proven to be
nothing but Microsoft butt kissers and apologists. They love to
PRETEND to be computer experts, legal experts and so on. Fat chance,
not even close.

Read the EULA for yourself and do not just listen to others
interpretations.
Then consult with an attorney specializing in software licensing law
if you still have questions.

"retail copy of an OEM"
There is no such thing, it is either retail or OEM and is not both.

If you mean you need to purchase a generic OEM, go to your favorite
shop that sells computer supplies and they should be able to sell OEM.

I wasn't listening to anyone, just pointing out the flaw in that
interpretation.

I didn't point out that I don't need a serial number. I have a new,
legal, unused serial number but a CD that is destroyed (long story)
I just need a CD or a download that I can bun. All absolutely legal.
