upgrade older computer system to OEM XP

I have a family member that wants to reinstall her system, problem is,
the hard drive is almost full, is older system, and is a used system
with NO OS CDs, so reading some information on previous postings of
OEM disks, I thought that the best option is a OEM CD of win XP, which
is listed from www.tigerdirect.com for $100. no they know that once I
install the OS, there is no other files of theirs on it. to be on
safe side, will be backing up their files to a portable CD burner that
I have. so to simply the question and all legal terms, would I be
better to use a full OEM win XP cd, or just go to local wal-mart for
win XP upgrade version, and when asked for older Windows CD, just use
a older win ME to allow it o install to system XP on a clean install
then. my own system orgianlly came wit win 98SE, and the upgrade XP
did not want to INSTALL over the older HP OEM version to system, and
then had to use old ME upgrade ME CD then. the ME is not installed to
system at all and is no loger really needed. my family members system
has older win 98 on it, and wants system upgraded, I know that ME will
ask for a OEM cd they do not have. SO, to he point is it beter to use
a OEM XP CD for the clean install to thier system, or simply easy way,
buy a upgrade XP CD, when prompted to insert a older windows CD, se
the ME CD that is mine, then have XP take over and install to their
system then? please reply soon.

How old is the "older" system? have you checked that it meets the
minimum spec for XP in the first place?

Assuming WinXP will run on her old PC.....

You need to be aware that if you buy the OEM version your support will come
from the company that sold it to you not Microsoft. Sure you can still use
these news groups and online help systems but if she needs to actually
_call_ MS they will ask for her product key and then refer her to the
company you got it from.

The reason that the OEM version is cheaper than the full retail version is
because the company selling it believes they can provide support that much
cheaper than microsoft can.

OEM will only do clean installs, no upgrades. You can use any Windows
CD since Windows 95 as qualifying media to do an XP upgrade with a
retail Upgrade CD.

The main problem for XP on the computer you've described is that the
harddrive is nearly full. Windows XP needs lots more room to breathe
than Windows 98.

If you want to upgrade, you need to use the OS for that PC. You cannot
use the OS install CD (License) from another PC as qualifying original
OS (should you do a clean install and require insertion of the
original OS CD), especially an OEM copy, as the license to that is
tied to the orignal PC, despite it not being installed on it.

You are legally better off using the full version of XP, OEM or
otherwise.

Says who? And the OS that is already on that computer is qualifying
media enough to do an upgrade with XP, if doing an upgrade install of
XP, then he souldn't even be prompted for a CD.
You cannot
use the OS install CD (License) from another PC as qualifying original

original OS CD), especially an OEM copy, as the license to that is

A retail copy of a previous MS OS isn't tied to any machine if it's not
installed on any computer, it's tied to the person that bought it. Even
with the narrowest reading of MS's EULA.
You are legally better off using the full version of XP, OEM or
otherwise.

Of course then the OP won't be able to do an upgrade then, because OEM
copies of XP can't do upgrades. So "legally" you have stated a whole
bunch of meaningless nonsense. You wouldn't know "legally" if it driven
up your ass with a Mack Truck!

well, from what you all say, her best option is to most difentily just
buy a new system, much cheaper and easy to do, but as I last recall,
her system had 100 MB free on a 3.0 GB drive, a new hard drive and
just an XP upgrade should surfice for her as long as she has 64 MB of
memory and at least a 233 MHZ processor. I kinda figured the OEM
version would be cheaper to do since I was going to do the clean
install on her system.

64MB of RAM isn't nearly enough, and neither is the processor, so
whatever OS she's running now will 5x better than XP on that config, if
you can even get XP to install in it at all. Tell her to buy the
cheapest computer she can afford from a major OEM. It will be at the
very least ten times better, and a hell of a lot less hassle all around.

right after last reply, called her on phone to check, may actually end
up going to waly world for computer, or better yet, hae it ordered
from mail order and build it to her needed specs, IE.. new box with
exras package. case mods seems to have a nice way to build system,
and my work has the cool automotive colors spray paint, such as 3 step
under coat purple, coat of green and clear coat to have two-tone paint
job, according to light, will change colors.

Sounds like a cool idea. My idea of case mod-ing is to keep the covers
off the case. Building a single computer is more expensive than buying
one thru mail order, but you know what you're getting components-wise.
